The Dindoshi Sessions Court in Mumbai has dismissed the bail application of Pratik Gaikwad, an absconding accused in the case. Pratik Gaikwad, along with his sister Pallavi Chandrakant Gaikwad, is accused of blackmailing Milind Borkar, a man who came to India from the U.S. to marry Pallavi.

Earlier, based on an order by the Andheri Metropolitan Court in Mumbai, Versova Police registered a case against Pallavi Gaikwad, her father Chandrakant Gaikwad, her brother Pratik Gaikwad, and Sanjeev Sonawane under sections 389, 385, 504, 506, and 34 of the Indian Penal Code (IPC).

The Andheri Court issued an arrest warrant against the accused for failing to appear in court despite being summoned. Following this, the accused filed an anticipatory bail application in the Sessions Court. During the hearing, Borkar’s lawyer, Sanjay Shukla, opposed the application and demanded that Pratik and Pallavi’s mobile phones be submitted for examination, which would help investigate the data theft. It is alleged that Pratik avoided appearing in court due to the fear that submitting the phones would expose the false accusations. Consequently, the Sessions Court rejected the anticipatory bail application.

What is the case?

As per the complaint, Milind Borkar, who has been working for a reputable company in the U.S. since 2007, came to Mumbai in 2019 to get married. He met Pallavi Gaikwad from Morwadi, Pimpri, through a matrimonial website, and the two got engaged in June 2019. According to allegations by Milind, before the wedding he discovered obscene photos and videos of Pallavi with other men on her phone. After this discovery, he decided to break off the engagement.

Vindictive by the broken engagement, Pallavi and her family demanded that Milind either marry her for six months and then divorce or pay ₹2.5 million. They also threatened to falsely implicate him in legal cases and ruin his career if he refused to comply.

The matter escalated when Pallavi lodged a complaint against Milind in Pimpri, accusing him of defaming her. She also informed both Milind’s company and immigration authorities in India and the U.S., stating that an FIR had been filed against him. This was allegedly done to defame him and prevent him from marrying someone else in the U.S. However, after an investigation revealed the truth, the Pimpri police suspended two officers who had filed the false FIR against Milind.

Milind fought a legal battle both in Mumbai’s Andheri Metropolitan Magistrate Court and San Francisco Superior Court in the U.S. He presented evidence, including obscene photos, videos, WhatsApp chats, and call recordings of Pallavi with other men. After reviewing the evidence, the Andheri court ordered the police to file a case against Pallavi and her family. While Pallavi and two other accused are out on bail, sources suggest that the police are still searching for her brother, Pratik Gaikwad.
